These Terms of Service (“Terms”) govern your access to and use of JoanCrisAloe.com (the “Site”) and your purchase or use of products offered by Joan Cris (“Joan Cris,” “we,” “us,” or “our”).

By accessing the Site, placing an order, or using any part of our services, you agree to these Terms. If you do not agree, please do not use the Site or purchase our products.

1. Eligibility

You must be at least 18 years old, or the legal age of majority where you live, to place an order through the Site. By using the Site, you represent that you are legally capable of entering into a binding agreement.

You may not use our products or services for any unlawful or unauthorized purpose.

2. Health and Product Disclaimer

Information provided on the Site—including product descriptions, ingredient information, wellness content, testimonials, articles, graphics, and other materials—is provided for general informational purposes only.

Nothing on the Site is intended to constitute medical advice, diagnosis, treatment, or a substitute for advice from a qualified healthcare professional.

These statements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease.

You are responsible for determining whether a product is appropriate for your individual needs. Do not use any product if you are allergic or sensitive to one or more of its ingredients.

Products intended for consumption must be stored and used according to their labels, including any refrigeration instructions. Joan Cris is not responsible for damage, spoilage, or adverse effects caused by improper handling, storage, alteration, or use.

4. Product Availability

All products are subject to availability. We may limit quantities, discontinue products, modify product packaging, or refuse or cancel an order at our discretion.

Product photographs are provided for illustration. Packaging, label design, color, and other visual details may vary without affecting the identity or intended use of the product.

We do not guarantee that products or services shown on the Site will always remain available.

5. Pricing and Payment

Prices are shown in U.S. dollars unless otherwise stated. Prices, promotions, discounts, and product availability may change without notice.

You agree to provide current, accurate, and complete billing and payment information. By submitting payment information, you represent that you are authorized to use the selected payment method.

Applicable taxes, shipping charges, and other fees will be displayed during checkout when required.

If a product is listed at an incorrect price due to a typographical, technical, or pricing error, we may cancel the order and issue a refund for any amount already paid.

Discount codes cannot be combined unless expressly stated. Promotions may be changed or discontinued at any time and may be subject to additional restrictions.

6. Order Acceptance and Cancellation

An order confirmation does not necessarily mean that we have accepted your order. We reserve the right to accept, decline, limit, or cancel an order for reasons including:

  • Product availability

  • Suspected fraud or unauthorized activity

  • Incorrect pricing or product information

  • Payment verification problems

  • Resale activity or unusually large quantities

  • Shipping restrictions

  • Violations of these Terms

If we cancel an order after payment has been collected, we will refund the amount charged for the canceled portion of the order.

Once an order has entered processing or shipment, we may be unable to modify or cancel it.

7. Shipping and Delivery

Shipping estimates are estimates only and are not guaranteed delivery dates. Delays may occur because of carrier disruptions, weather, holidays, address problems, inventory issues, or circumstances outside our reasonable control.

Customers are responsible for providing a complete and accurate shipping address. We are not responsible for delays, losses, or additional charges resulting from an incorrect or incomplete address provided by the customer.

If your package arrives damaged, contains an incorrect product, or appears to be missing an item, contact sales@joancrisaloe.com promptly and include your order number and photographs when applicable.

8. Returns and Refunds

We accept returns of products purchased through our Site within 30 days of the original purchase date, provided the product is unopened, unused, and remains in its original sealed packaging.

To request a return, email sales@joancrisaloe.com and wait for return instructions before sending the product back.

Opened, used, damaged after delivery, or unsealed products are non-returnable and non-refundable unless otherwise required by law. After 30 days from the purchase date, all sales are final.

Additional details may be provided in our Refund Policy, which is incorporated into these Terms by reference.

9. Wholesale Inquiries

Submitting a wholesale application or inquiry does not guarantee approval, pricing, product availability, territory protection, or a business relationship.

Approved wholesale purchases may be governed by separate written terms, invoices, minimum-order requirements, resale restrictions, and payment arrangements. If separate wholesale terms conflict with these Terms, the separate written wholesale terms will control for that transaction.

10. Website Content and Accuracy

We work to provide accurate product, pricing, ingredient, and availability information. However, the Site may occasionally contain typographical errors, inaccuracies, or omissions.

We reserve the right to correct errors, update information, or cancel affected orders at any time, including after an order has been submitted.

Information on the Site is provided for general informational purposes and should not be relied upon as the sole basis for making medical, health, or other important decisions.

11. Reviews, Testimonials, and Submitted Content

Reviews and testimonials reflect the personal experiences and opinions of individual customers. They do not guarantee that another customer will experience the same results.

If you submit a review, photograph, comment, suggestion, testimonial, or other content to us, you represent that:

  • The content is truthful and based on your genuine experience

  • You own the content or have permission to submit it

  • The content does not violate another person’s rights

  • The content is not unlawful, defamatory, deceptive, or misleading

You grant Joan Cris a nonexclusive, worldwide, royalty-free license to use, reproduce, edit, publish, display, and distribute submitted content for business and promotional purposes, subject to applicable law.

We may remove submitted content that violates these Terms, but we are not obligated to publish or retain any submission.

12. Intellectual Property

The Site and its contents—including the Joan Cris name, logos, product names, label designs, photographs, graphics, videos, text, layouts, and other materials—are owned by or licensed to Joan Cris and are protected by applicable intellectual-property laws.

You may use the Site only for personal, noncommercial purposes. You may not copy, reproduce, modify, distribute, publish, sell, exploit, or create derivative works from our content without prior written permission.

Nothing in these Terms grants you ownership of or a license to use any Joan Cris trademark, trade dress, logo, or other proprietary material except as expressly authorized in writing.

13. Prohibited Uses

You may not use the Site:

  • For any unlawful, fraudulent, or deceptive purpose

  • To violate another person’s legal or intellectual-property rights

  • To transmit malware, harmful code, or disruptive technology

  • To scrape, harvest, copy, or commercially exploit Site content

  • To interfere with the security or operation of the Site

  • To submit false reviews, testimonials, or account information

  • To impersonate another person or organization

  • To make unauthorized purchases or fraudulent chargebacks

  • To resell products in a misleading, altered, expired, or improperly stored condition

  • To suggest that Joan Cris endorses you or your business without written permission

15. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE, ITS CONTENT, AND ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

JOAN CRIS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. WE DO NOT WARRANT OR GUARANTEE ANY SPECIFIC HEALTH, WELLNESS, FINANCIAL, OR OTHER RESULT FROM THE USE OF OUR PRODUCTS.

NOTHING IN THESE TERMS EXCLUDES A WARRANTY OR CONSUMER RIGHT THAT CANNOT LAWFULLY BE EXCLUDED.

16. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JOAN CRIS AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AFFILIATES, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO:

  • Your use of or inability to use the Site

  • Your purchase, storage, misuse, or use of a product

  • Reliance on information provided through the Site

  • Third-party conduct, services, websites, or content

  • Unauthorized access to or alteration of your information

  • Shipping delays or events outside our reasonable control

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM RELATING TO A PURCHASE WILL NOT EXCEED THE AMOUNT YOU PAID TO JOAN CRIS FOR THE PRODUCT GIVING RISE TO THAT CLAIM.

Some jurisdictions do not permit certain limitations of liability. In those jurisdictions, these limitations apply only to the maximum extent permitted by law.

17. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Joan Cris and its owners, employees, affiliates, contractors, suppliers, and service providers from claims, damages, losses, liabilities, and reasonable legal expenses arising from:

  • Your violation of these Terms

  • Your unlawful or unauthorized use of the Site

  • Your misuse, alteration, resale, or improper storage of a product

  • Content you submit

  • Your violation of another party’s rights

This provision does not require you to indemnify Joan Cris for conduct for which indemnification may not lawfully be required.

18. Privacy

Your submission of personal information through the Site is governed by our Privacy Policy. By using the Site, you acknowledge that you have reviewed that policy.

19. Electronic Communications

By using the Site or contacting us electronically, you consent to receive transactional communications electronically, including order confirmations, shipping notices, account messages, policy notices, and customer-service responses.

Marketing emails and text messages, if offered, are subject to any additional consent language presented when you subscribe. You may unsubscribe from marketing communications using the instructions provided in those messages. Unsubscribing from marketing does not prevent necessary transactional communications.

20. Governing Law and Venue

These Terms and any dispute arising from the Site or a purchase from Joan Cris will be governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Subject to applicable consumer-protection laws, any legal proceeding arising from these Terms will be brought in a state court located in Hidalgo County, Texas, or a federal court serving Hidalgo County, Texas. You consent to the jurisdiction of those courts.

21. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

22. No Waiver

Our failure to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.

23. Entire Agreement

These Terms, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies posted on the Site, constitute the entire agreement between you and Joan Cris regarding your use of the Site and online purchases.

24. Changes to These Terms

We may update these Terms when our practices, services, or legal obligations change. Updated Terms will be posted on this page with a revised effective date.

Your continued use of the Site after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
